Of the some 350 women's refuges in Germany, about 130 are known as autonomous women's refuges, a term expressing their independence from political parties and religious denominations. Frequently they go by the association name of "Frauen helfen Frauen" (women helping women), so even the name on its own reflects further important principles of their work.
Autonomous women's refuges have made it their goal to raise public awareness of violence against women, girls and boys at all levels of society, thereby stripping it of taboos and helping in the struggle to bring it to an end. They support women, girls and boys affected by violence by offering shelter, accommodation and advice.
Autonomous women's refuges are places at which women, girls and boys are strengthened and encouraged. An autonomous women's refuge is a place of mutual learning. Social welfare is replaced by solidarity and partiality, while the analysis of society is founded on feminist and race-aware principles. The staff and association representatives see the patriarchal social and power structures as being the greatest cause of the violent relationships that exist.
The autonomous projects have become autonomous institutions which are finding themselves increasingly valued by local and district authorities because of their expert and committed work.
The majority of autonomous women's refuges continue to operate on an independent administrative footing with basic democratic elements. This includes giving the occupants of women's refuges a say. The staff of the autonomous women's refuges generally work and take decisions as teams in which everyone is equal.

Guided by these principles, the autonomous women's refuges practise forms of community other than the prevailing ones, thereby highlighting ways out of violent relationships. They take an integrated approach and work constantly towards the goal of a society marked by solidarity, togetherness and the equal participation of all humans.

History
As the number of women's refuges began to grow, delegates attending the 8th national (later federal) women's refuge congress in Braunschweig in 1980 decided to establish the Zentrale Informationsstelle Autonomer Frauenhäuser (ZIF) in Hamburg as a networking, information and coordination centre. Initially the ZIF's location changed every year.
Even by this time, the women's refuge initiatives could already look back on a brief but exciting history. While in 1975, which the UN called International Women's Year, there was still not a single place in the then West Germany to which abused women and their children could go to find shelter, just one year later women's refuges were beginning to be opened under the auspices of the new women's movement, first in West Berlin in October 1976 and then in Cologne in November 1976. Encouraged also by experience in England, where a number of women's refuges were already in existence by this time, women's refuge initiatives/groups were established in many West German towns with the aim of creating a network of self-managing refuges.
The ZIF has been based in a number of different cities since 1980: Hamburg, Göttingen, Marburg, Erlangen, Siegen, Esslingen, Kassel, Bonn and, since 2018, Heidelberg, with an office in Mannheim.
How women's refuges are funded
There have been women's refuges in Germany since 1976. Their funding since then has been unregulated and inadequate. How a women's refuge is resourced with staff and premises depends essentially on the political will of the local authority and relevant federal state. As yet – apart from a state law in Schleswig-Holstein – there is no legislation that secures funding.
The "Federal government report on the situation of women's refuges, specialist advice centres and other support options for women affected by violence and their children" (August 2021) highlights the patchwork of different funding regulations in existence, which differ from one state to the next and one local authority to the next – and sometimes even within the same local authority.
Closely related to the question of how women's refuges are funded is access to shelter and assistance for women affected by violence and their children. The more complicated, cumbersome and indeed off-putting this access is, the less effective it can be. Rapid, hassle-free admission to a women's refuge can save the lives of women and children, who may be put in danger if admission is not granted.

Since 2007 the various women's refuges organisations themselves have been reiterating the call for reliable, unbureaucratic and uniform nationwide regulations on the funding of women's refuges. These must not impose additional burdens or threats on women affected by violence and their children.
In the view of the autonomous women's refuges, this can only be guaranteed through the funding of protection and assistance on a non-case-by-case basis. Only the flat funding of women's refuges can ensure that all women affected by violence and their children get safe, rapid and hassle-free access to protection and demand-led support in the women's refuge of their choice.

Only federal regulation can ensure binding laws giving equal access to the refuges across the country. Women's refuges are, by their nature, cross-regional organisations, because women often flee in fear to women's refuges some distance away, such as in other states. Only uniform, nationwide rules can ensure the necessary protection and vital assistance of women affected by violence and their children across city and regional boundaries without restriction – free of disputes on jurisdiction and funding, free of obstacles under asylum law. Furthermore, it is in the interests of women affected by violence that the diversity of support organisations with different concepts and programmes is retained and safeguarded going forward.
Rapid and unbureaucratic admission to a women's refuge is most made difficult by what is known as day rate funding, where the costs of a stay in the women's refuge are passed on to the women and their children: women with sufficient income must meet the costs of their own stay in a refuge, while women without sufficient income have to apply for social benefits (usually "Hartz IV") – even if they would not need any social benefits to support themselves.
This type of funding has been proven to act as an insuperable barrier for many women affected by violence and their children, and it threatens their prompt and unbureaucratic protection to a considerable extent.
Day rate funding concepts based on the individual case identify the women affected by violence as the problem, overlook the societal and systemic causes of violence and thereby ignore the need for fundamental change in society. They always send the same message:
Each women is responsible for the violence she suffers, and she herself must change – not society. Each woman is responsible for funding her own protection – not society.
Furthermore, a considerable number of women are not guaranteed access to a women's refuge due to a lack of secure funding. For instance, apprentices, students, adult learners, women without assured residence status and women with limited residence options/obligations cannot normally be admitted to refuges funded on a day rate basis because they are not entitled to benefits under the provisions of SGB II/SGB XII and their stay will not be funded. High day rates in women's refuges compel women who earn their own income to apply for social benefits that they would not otherwise need. This dissuades women with their own income from seeking admission to such refuges.
Although staff in women's refuges are working with extraordinary dedication and improvisational talent to develop creative solutions so that women not entitled to benefits according to SGB II can still be admitted to refuges funded on a day rate basis, often these fail simply due to a lack of financial resources, particularly in the case of women with children.
One of the most fundamental problems with day rate funding is that the provisions of SGB II which underpin the day rates of most women's refuges funded on a day rate basis (local authority integration services pursuant to section 16a no. 1 and 3) were never intended for the funding of refuges. They were instead designed to enable or facilitate the commencement of employment. This has resulted in constant disputes between individual local authorities on the reimbursement of case-specific refuge costs, frequently ending up in court. These disputes take up a great deal of time and effort for staff in the women's refuges and for job centres in the local authorities.
Experience has shown that the pressure on costs is passed on to the occupants of the refuges. The funding agencies are forcing these refuge occupants to keep their stay in the refuge as short as possible, or even denying it altogether, regardless of their need for protection and support, and ignoring their right of self-determination.
Women's refuge staff are being forced to provide comprehensive social reports – ignoring their duty of confidentiality – on the women they accommodate and their need for support. The decision on the need for or termination of a stay in a women's refuge has thus ended up in the hands of the social benefit agencies and is being determined less and less by the needs of the women affected by violence.
The only possible solution to this problem is for the funding of protection and help in the women's refuge to be guaranteed regardless of the individual case.
For the reasons itemised below, the autonomous women's refuges have cause to believe that an individual legal entitlement would significantly increase the bureaucratic hurdles faced by women affected by violence in finding a place in a refuge:
I. No legal entitlement without burden of proof
If the funding of women's refuges depends on women affected by violence and their children having to assert an individual legal entitlement to claim a social benefit to fund their stay in a refuge, there are concerns that, to save costs, funding agencies would set up new hurdles for admission, such as the following:
- The women's refuge may only admit women who have asserted a legal entitlement to the corresponding social benefits for themselves and their children.
- The burdens of proof required in order to assert a legal entitlement and draw the appropriate benefits under the German Social Codes correspond to those set out in SGB I. cf. SGB I, sections 38, 40, 60. It follows that those who wish to assert a legal entitlement to social benefits must meet the corresponding requirements (section 40). To determine whether these requirements are met, all the facts that are of significance for the benefit must be specified. At the request of the competent service provider, consent must be given to the disclosure of the necessary information by third parties. Items of evidence must be identified and, at the request of the competent service provider, such evidence must be submitted or agreement to its submission must be given (section 60).
- Anyone unable to submit (objective) evidence for the violence suffered cannot assert a legal entitlement for themselves or their children and so cannot be admitted to the women's refuge or must leave the refuge after the situation has been clarified.
The admission of women affected by violence and their children is already being made more difficult in some local authorities, districts and federal states for reasons of cost. Women's refuges are, for instance, complaining that they are not supposed to admit women from outside their area or state. In many local authorities and districts women are having to leave the refuge as quickly as possible for reasons of cost. Women who have an uncertain residence status are not even to be admitted in the first place because the costs are not reimbursed. It is a similar picture for women not entitled to social benefits. The situation is exacerbated by disputes on the reimbursement of costs right through to court proceedings between individual local authorities.
II. Individual legal entitlement = individual funding?
The demand for an individual legal entitlement does not address the question of how the women's refuges are funded. As explained above, however, if refuges were funded by means of a monetary payment act, i.e. on a case-by-case basis, this would make it more difficult for women affected by violence and their children to access prompt and unbureaucratic protection and the help they need in their situation.
It has since been amply demonstrated that funding on a case-by-case basis excludes whole groups of women, e.g. migrants without (assured) residence, EU citizens, wives with joint assets, students and apprentices. Women with their own income or property are compelled to draw social benefits because they are generally unable to pay the high day rates from their own earned income. In order to fund their stay in the refuge, these women have to apply for social benefits which they would otherwise not need to support themselves. This means they are having to pay for their own protection and support and even get into debt so they can afford to stay in the refuge.
For political reasons, too, we believe funding on a case-by-case basis to be the wrong path. It identifies the woman who is affected by violence as the problem, while the social causes of violence against women are ignored.
III. Full implementation of the Istanbul Convention instead of a legal entitlement
Our goal is the full implementation of the Istanbul Convention, which – among other things – demands rapid and unbureaucratic access for women affected by violence and their children to demand-led protection and professional support, regardless of their residence status, place of residence, income, assets, educational or occupational situation. This goal can only be achieved effectively and comprehensively by departing from case-by-case funding and opting instead for the reliable and demand-led funding of women's refuges on a statutory basis regardless of the individual case.
We therefore continue to demand the following:
- Free, rapid and unbureaucratic access for women affected by violence and their children to a women's refuge of their choice, regardless of their residence status, place of residence, income, assets, educational or occupational situation or possible impairments.
- A departure from the day rate (case-by-case) funding model, and instead – together with the CEDAW Alliance and the German Women's Council – a mechanism for the funding of women's refuges that is demand-led and independent of individual cases and is enshrined in federal law, so that it applies to all states.
- A binding, permanent and appropriate apportionment of the necessary financial resources between federal, regional and local government. This is the only way delivery of the demand-led services of women's refuges can be protected. It is essential for the support organisations, however, that the necessary resources come from one source.
- Federal legislation on funding, because only that will allow equal access to the refuge system to be enshrined in binding regulation across the country.
